Agreement to Terms

These Terms and Conditions ("Terms") govern your use of ProGuard Pest Control's services and website. By engaging our services or using our website, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our services.

Services

Service Description

ProGuard Pest Control provides professional pest control and extermination services for residential and commercial properties. Our services include but are not limited to inspection, treatment, prevention, and ongoing maintenance programs for various pest issues.

Service Scheduling

Services are provided by appointment. We will make reasonable efforts to arrive during the scheduled time window. Emergency services may be available for an additional fee.

Access Requirements

You must provide access to all areas requiring treatment. Failure to provide access may result in incomplete service and additional charges for return visits.

Pricing and Payment

Quotes and Estimates

All quotes and estimates are valid for 30 days from the date of issuance. Prices are subject to change based on property conditions discovered during inspection or service.

Payment Terms

  • Payment is due upon completion of service unless other arrangements have been made
  • We accept cash, check, and major credit cards
  • Late payments may be subject to interest charges of 1.5% per month
  • Returned checks will incur a $35 processing fee

Cancellations

Cancellations must be made at least 24 hours before the scheduled appointment. Late cancellations or no-shows may be subject to a cancellation fee of up to $75.

Service Guarantee

We stand behind our work with a satisfaction guarantee. If pests return between scheduled service visits, we will return to re-treat at no additional charge, subject to the following conditions:

  • Customer must notify us within 30 days of the original service
  • Customer has maintained the property in accordance with our recommendations
  • The guarantee applies to the specific pests treated in the original service
  • Customer has fulfilled all payment obligations

This guarantee does not cover new infestations, different pest species, or re-infestations caused by conditions beyond our control.

Customer Responsibilities

To ensure effective pest control services, customers agree to:

  • Provide accurate information about the pest problem and property conditions
  • Follow all preparation instructions provided by our technicians
  • Remove or cover food, dishes, and pet items as instructed
  • Keep children and pets away from treated areas as directed
  • Notify us of any health conditions, allergies, or sensitivities
  • Maintain the property in a sanitary condition
  • Follow post-treatment instructions and recommendations

Limitations of Liability

ProGuard Pest Control's liability is limited to the amount paid for the specific service in question. We are not liable for:

  • Damage caused by pests before, during, or after treatment
  • Consequential, indirect, or incidental damages
  • Treatment failure due to customer non-compliance with instructions
  • Damage to property caused by following customer directions
  • Pre-existing damage or conditions discovered during service
  • Actions or inactions of previous pest control providers

Safety and Chemicals

We use EPA-registered products applied by licensed professionals. All products are used in accordance with label instructions and applicable regulations. We maintain liability insurance and workers' compensation coverage as required by law.

Material Safety Data Sheets (MSDS) are available upon request for any products used on your property.

Indemnification

You agree to indemnify and hold harmless ProGuard Pest Control from any claims, damages, or expenses arising from your failure to follow instructions, provide accurate information, or maintain your property in accordance with our recommendations.

Termination of Services

Either party may terminate ongoing service contracts with 30 days written notice. We reserve the right to terminate services immediately if:

  • Payment obligations are not met
  • Customer fails to provide necessary access
  • Customer violates these Terms
  • Unsafe or threatening conditions exist

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of ProGuard Pest Control and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Your County, California.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
